PMC Property Management (comprising PMC Property Management NSW Pty Ltd, ACN 617 043 222, and PMC Property Management Pty Ltd, ACN 168 144 509) is committed to complying with our obligations under the Privacy Act 1988 (Cth) (the Act) and other applicable privacy laws and regulations.

The Act allows personal information to be collected, used and disclosed for the purposes for which it was collected, in accordance with the Act.

This Privacy Policy describes how we may collect, hold, use and disclose your personal information, and how we maintain the quality and security of your personal information.

This Policy may be revised, updated or replaced from time to time. Any changes take effect on the date the revised Policy is posted.

 

What is personal information?

“Personal information” means any information or opinion, whether true or not, and whether recorded in a material form or not, about an identified individual. In general terms, this includes information or an opinion that personally identifies you either directly or indirectly.

 

What personal information do we collect?

The personal information we collect about you depends on the nature of your dealings with us — for example, whether you are a tenant, a rental applicant, a landlord or property owner, or another party to a tenancy. This may include (but is not limited to):

  • name
  • contact details (address, phone number, email address)
  • date of birth
  • identity documents (for example, your driver licence, passport, or visa and work rights documentation)
  • financial information (for example, payslips, bank statements or proof of income)
  • banking details
  • rental history and references
  • employment details
  • household details (for example, other occupants, children or pets)
  • emergency contact details
  • property ownership and management details (for landlords and owners)
  • property access information (for example, keys or access codes)
  • condition report photographs
  • health, disability, family violence or other sensitive information you choose to share with us to support a request

You can browse our website without disclosing your identity to us; however, if you submit an enquiry, a rental application, or otherwise contact us through the website, you will need to provide contact details so that we can respond. If you choose to interact with us anonymously, or choose not to provide your personal information, we may not be able to provide you with our services or otherwise interact with you.

 

Why do we collect this information?

We use personal information for purposes connected with our functions and activities, including:

  • providing property management services, including letting, rent collection, inspections and maintenance coordination
  • assessing and processing rental applications
  • managing the landlord and tenant relationship, including compliance with tenancy and management agreements
  • delivering a more personalised experience and service offering
  • improving the quality of the services we offer
  • internal administrative purposes
  • complying with our legal and regulatory obligations, including under residential tenancies legislation

 

How do we collect your personal information?

We collect your personal information directly from you when you:

  • interact with us over the phone or in person
  • interact with us online, including through our website or a rental application platform
  • submit a rental or tenancy application
  • attend a property inspection
  • participate in surveys or questionnaires
  • subscribe to our mailing list
  • apply for a position with us as an employee, contractor or volunteer

 

Collecting personal information from third parties

We may also collect your personal information from third parties, for example: previous landlords or property managers, employers, personal referees, tenancy database operators, and tribunals such as the NSW Civil and Administrative Tribunal (NCAT) or the Queensland Civil and Administrative Tribunal (QCAT). We collect this information to assess rental applications and manage tenancies.

 

Automated Decision Making (ADM)

ADM refers to the use of a computer program to make a decision, or to do something substantially and directly related to making a decision, where that decision could reasonably be expected to significantly affect the rights or interests of an individual.

We do not currently use ADM in connection with this website.

 

Information disclosed

We may disclose your personal information to third parties in circumstances where you would reasonably expect us to disclose your information, including to:

  • our third party service providers
  • our offshore administrative support team
  • our professional services advisors
  • parties assisting us with maintaining and updating our records
  • parties assisting us to compare information for accuracy, and verify it with third parties
  • residential tenancy database operators, in the circumstances described below
  • a relevant government body or authority, or as otherwise authorised or required by law

 

Residential tenancy databases

Where you breach your tenancy agreement, we may list information about you in a residential tenancy database, in accordance with the requirements of the residential tenancies legislation that applies in your state. Before doing so, we will take reasonable steps to notify you and give you an opportunity to respond, as required by law.

 

Overseas disclosure

We do disclose personal information overseas. Our property management team is supported by offshore administrative staff based in the Philippines, who assist with administrative tasks and may have access to personal information in the course of that work.

 

Website analytics

Our website uses Google Analytics and ExactMetrics to help us better understand visitor traffic, so we can improve our services. Although this data is mostly anonymous, it is possible that under certain circumstances we may connect it to you. We do not use cookies on this website.

When you visit this website, our server may log certain information, including the type of browser and operating system you are using, the top-level domain name, the address of the referring site, the server’s IP address, the date and time of your visit, and the pages accessed. This information is generally used only for internal statistical analysis and system administration purposes.

 

How do we protect your personal information?

We take reasonable steps to ensure that the personal information we hold about you is kept confidential and secure, including by:

  • maintaining robust physical security of our premises and databases/records
  • restricting access to personal information to personnel who need it to provide services to you
  • using technological measures such as anti-virus software and firewalls

No transmission of information over the internet can be guaranteed to be completely secure, and we do not warrant the security of any information transmitted to us over the internet.

 

Retention of personal information

We will not keep your personal information for longer than we need to. In most cases, this means we will only retain your personal information for the duration of your relationship with us (including as a landlord, tenant or rental applicant), unless we are required to retain it to comply with applicable laws, such as residential tenancies legislation and trust account record-keeping requirements. Where you apply for a tenancy but are not successful, we will not retain your application information for longer than is reasonably necessary for that purpose.

This website may contain links to other websites. We are not responsible for the privacy practices or content of those websites, and this Policy does not extend to those linked websites.

 

Marketing and opt-out

We may use your personal information (excluding sensitive information) for marketing, research and to improve our products and services, and to let you know about offerings from us or our related entities that may interest you, unless you tell us otherwise. You can unsubscribe at the bottom of any marketing email from us. We will not use your sensitive information for marketing without your consent.

Inquiries and complaints

For complaints about how PMC Property Management handles, processes or manages your personal information, please contact us at enquiry@pmcproperty.com.au. We may require proof of your identity and full details of your request before we can process your complaint.

It will not always be possible to resolve a complaint to everyone’s satisfaction. If you are not satisfied with our response, you have the right to contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au, by phone on 1300 363 992, or by post to GPO Box 5288, Sydney NSW 2001.
